Terms of Service
These Terms of Service ("Terms", "Agreement") form a legal agreement between you ("Customer", "User") and Velcor Energy LLC ("Velcor", "we"). By accessing, browsing, or using velcorenergy.com, the customer portal, or any service offered by Velcor, you agree to these Terms in full. If you do not agree, please refrain from using our services.
011. Acceptance of agreement
By submitting an electricity service request, registering in the customer portal, or contacting our team through any channel, you confirm that: (a) you are at least 18 years old, (b) you have legal capacity to contract, (c) the information you provide is true, accurate, and up-to-date, and (d) you accept these Terms and our Privacy Policy.
022. Nature of the service
Velcor Energy LLC is an electricity service facilitator in the deregulated Texas market. We act as a bilingual guide connecting residents and businesses with PUCT-certified Retail Electricity Providers (REPs). Velcor is NOT the final electricity provider; supply and billing are handled by the REP you contract with.
033. Estimates and quotes
Estimated monthly consumption, kWh charges, TDU fees, and projected billing are calculated using public meter data (ESIID) and authorized rate-comparison APIs based on your address, ZIP, and service type. They are for reference and do not constitute a contractual offer. Your actual bill will depend on: (a) your effective kWh usage, (b) local utility pass-through TDU charges, (c) applicable federal/state/municipal taxes, and (d) the terms of the specific plan you sign.
044. Request and activation process
Upon submitting the form you will receive an Order Number. Once your request is processed and eligibility verified (ESIID, deposit if applicable), we will email you a Customer Account Number used to access the customer portal, view bills, manage payments, and download your EFL. Average activation time is 1 business hour.
055. Right of rescission
Per PUCT rules, every new residential customer may cancel the contract without penalty within 3 federal business days of receiving the written contract. To exercise this right, send written notice to support@velcorenergy.com or call (800) 715-6516.
066. Billing, payments, and charges
Billing is issued directly by the REP you contracted with. Velcor may enable in-portal payments via Stripe as a technical facilitator. Late-payment fees, reconnection, connection/disconnection, and any other charges are governed by the REP's terms and published in the plan's Electricity Facts Label (EFL).
077. Deferred Payment Plan
If eligible, you may request a Deferred Payment Plan per PUCT Rule 25.480, allowing you to pay a high bill in interest-free monthly installments. Contact support@velcorenergy.com to request it.
088. Acceptable use
You agree NOT to: (a) use the site for illegal or fraudulent activities, (b) submit false information in forms, (c) attempt to access other accounts or systems, (d) disassemble, reverse-engineer, or automatically extract data (scraping), (e) interfere with site operation, or (f) impersonate another user or Velcor.
099. Intellectual property
All site content — Velcor brand, logo, designs, text, code, database, images, and documents — is the exclusive property of Velcor Energy LLC and is protected by U.S. intellectual property laws. Reproduction, distribution, modification, or commercial use without written authorization is prohibited.
1010. Electronic communications
By submitting your mobile number you accept transactional SMS and/or WhatsApp messages (confirmations, reminders, updates). You may opt out by replying STOP at any time. Standard carrier rates apply. By providing your email you accept transactional notifications; commercial communications are opt-in and can be canceled via the "unsubscribe" link in each email.
1111. Limitation of liability
Velcor Energy acts as a guide and facilitator. We are NOT liable for: (a) electric-service outages caused by the REP or utility, (b) REP billing errors, (c) PUCT or federal regulatory decisions, (d) price fluctuations beyond our control, (e) indirect, consequential, or punitive losses. Our maximum aggregate liability will not exceed $100 USD or the amount you paid Velcor in the last 12 months, whichever is greater.
1212. Indemnification
You agree to indemnify and hold harmless Velcor, its officers, employees, and agents from any claim, cost, or expense (including reasonable attorney fees) arising from: (a) your use of the site or services, (b) your breach of these Terms, or (c) your violation of third-party rights.
1313. Governing law and jurisdiction
This Agreement is governed by the laws of the State of Texas and applicable U.S. federal laws, without regard to conflict-of-laws principles. Any dispute will be resolved exclusively in state or federal courts located in Harris County, Texas. You waive any objection to jurisdiction and venue.
1414. Arbitration and class-action waiver
Any dispute not resolved informally shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA). YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS OR REPRESENTATIVE ACTIONS. You have 30 days from acceptance of these Terms to opt out by emailing legal@velcorenergy.com.
1515. Modifications
We may modify these Terms periodically by publishing the updated version with a new "Last revised" date. Continued use of services after a material modification (with 30 days' prior notice) constitutes acceptance. If you disagree, stop using the services and contact us to cancel your account.
1616. Severability and entire agreement
If any provision of these Terms is declared invalid or unenforceable, the remaining provisions will remain in full force. These Terms, together with the Privacy Policy and plan-specific PUCT documents (EFL, TOS, YRAC), constitute the entire agreement between the parties.
